Our New Jersey criminal defense firm has occasion to represent several hundred individuals every year who have been charged with marijuana possession and marijuana distribution. This article is intended to provide a thumbnail review of marijuana offenses in Union County NJ. To begin with, there are basically two pedigrees of marijuana cases - disorderly person charges (e.g. possession of less than 50 grams of marijuana in Union County) and indictable offenses (e.g. possession of in excess of 50 grams or possession with intent to distribute in Union County). A disorderly person offense is a misdemeanor that is not considered a "crime" under New Jersey law. An indictable charge is a felony and can be graded as a First Degree, Second Degree, Third Degree or Fourth Degree Crime. An individual is eligible for a Conditional Discharge in Union County where he or she has been arrested for possessing less than 50 grams and has not been afforded a diversion previously. A similar program, Pretrial Intervention ("PTI"), exists on the Union County Superior Court level for diverting Third Degree and Fourth Degree crimes for those with no prior diversion.
